SİNEMA ESERİ YAPIMCILARI MESLEK BİRLİĞİ
The main objective of the Professional Association of Film Producers (SE-YAP) is to protect the rights and interests of its member film producers, to ensure the collection of royalties arising from the use of its members’ productions, to monitor and collect these financial rights on behalf of rights holders in accordance with the principles and procedures set out in the legislation, and to distribute the collected revenues to the rightful owners.
In order for SE-YAP to carry out these activities on behalf of rights holders, an Authorization Certificate must be granted to SE-YAP by the rights holder. Upon granting this authorization, SE-YAP will have the authority to use the rights covered by the certificate in the form of a full license and will become exclusively authorized, within the scope of collective rights management, for the administration and monitoring of these rights, as well as the collection and distribution of royalties. As explicitly stated in the Authorization Certificate, this authority granted to SE-YAP is limited to collective rights management and does not include the commercial marketing or sale of the works belonging to its members on an individual basis.
Pursuant to Article 5/2 of the Regulation on Authorization Certificates to be Granted to Professional Associations, the rights specified in the authorization certificate are valid for all published or publicly disclosed works and related rights of the rights holder within the field of activity of the professional association.
However, as also stated in the same provision, the determination of the works and related rights over which professional associations have representation authority is based on notifications made by their members through the method determined by the association. Therefore, it is important for members to inform the professional association in order to ensure the complete identification of the works for which they hold rights and to enable the proper monitoring of those rights.
Our members may submit the WORK NOTIFICATION FORM to SE-YAP by completing and signing it* and sending it via email to seyap@se-yap.org.tr in order to notify SE-YAP of the works for which they hold rights.
* El ile imzalanan belgelerin okunaklı şekilde taranıp SE-YAP’a iletilmesi yeterli olup, belgenin ayrıca fiziksel olarak iletilmesine ihtiyaç bulunmamaktadır. Elektronik ortamda imzalanacak belgelerde ise, güvenli elektronik imza kullanılması gerekmektedir.
